Terms of Service
Last updated: [DATE]
1. Acceptance of terms
By creating an account or using OddJobber, you agree to these Terms. If you don't agree, don't use the service.
2. What OddJobber is
OddJobber is a marketplace that connects clients who need work done with independent providers who perform that work. OddJobber is not a party to the agreement between a client and a provider for any specific job, and does not itself perform, supervise, or guarantee the work.
3. Eligibility and accounts
- You must be at least 18 years old to use OddJobber.
- You're responsible for keeping your account credentials secure.
- Providers must complete identity verification (a live photo and bank account details, reviewed by our team) before they can bid on jobs.
- You agree to provide accurate information and to keep it up to date.
4. Independent contractor relationship
It is the intent of this agreement that providers using OddJobber to find and complete jobs are independent contractors, not employees, agents, or partners of OddJobber. Providers set their own rates (via bids), choose which jobs to accept, and are responsible for their own taxes, insurance, licensing, and compliance with applicable law.
Worker classification law varies significantly by state and country and carries real legal and financial risk if gotten wrong — this section in particular should be reviewed by an attorney familiar with the applicable jurisdictions before this document is relied upon.
5. Payments and escrow
- When a client accepts a bid, the agreed amount is charged and held in escrow by OddJobber's payment processor (Stripe) — not paid to the provider yet.
- Funds are released to the provider's wallet once the client approves the completed job.
- OddJobber retains a 10% commission on the job amount, deducted when funds are released to the provider.
- Clients are responsible for the full amount they agree to in a bid, plus any applicable payment processing fees.
6. Cancellations and disputes
Either party may raise a dispute if a job isn't completed as agreed. OddJobber will review the evidence submitted by both parties and make a determination on whether funds are released to the provider or refunded to the client. OddJobber's determination on disputes is final.
7. Prohibited conduct
- Circumventing the platform to pay or get paid outside of OddJobber for a job posted on it
- Submitting false identity, photo, or bank account information
- Harassing, threatening, or discriminating against another user
- Posting jobs or bids with no genuine intent to complete the transaction
8. Disclaimers and limitation of liability
OddJobber provides the platform "as is" and does not guarantee the quality, safety, or legality of any job posted or performed by users. To the maximum extent permitted by law, OddJobber is not liable for damages arising from interactions, transactions, or disputes between clients and providers.
9. Termination
We may suspend or terminate your account for violating these Terms, including fraudulent verification information or repeated disputes found in your favor without merit.
10. Governing law
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-law principles.
11. Changes to these terms
We may update these Terms from time to time. Continued use of OddJobber after a change means you accept the updated Terms.
